Asons Solicitors settles £7,000 for Client’s Hearing Loss Claim
Bolton, United Kingdom (PRWEB UK) 9 July 2013 -- According to court documents the Asons’ client, aged 46, advised that he was employed in the Assembly Department of a Sports Equipment Manufacturer; during his employment, the client used tools such as drills, mopping machines and polishing machines during the construction of various fitness paraphernalia.
According to the letter of claim Asons’ client was required to work in an excessively noisy environment whilst carrying out his duties; to communicate he was left with no other option but to shout. He worked for 40 hours a week, but often worked overtime on a weekly basis. While the client was permitted breaks each day, there was no separate canteen or break area; this meant that during the working day, there was no shelter from the noisy environment.
Asons Executive, Suzanne Yates, made the following statement:
“Our client worked in an environment that was extremely loud; According to our documents, there was no provision for suitable and efficient hearing protection during his employment. The company also failed to ensure that any noise or risk assessments were carried out, no measures were taken to determine whether or not the noise levels their employees were exposed to were safe.”
According to the court documents, the company failed to make their employees aware of the risks of noise exposure, and hence the potential injury it could cause. The client claims that none of the employees of the firm were provided with any information, supervision or training, nor were they informed as to how they could minimise the risk they were being exposed to. A safe system of work was not implemented, which could have prevented damage to the clients hearing.
Fortunately, cases of noise induced hearing loss, or industrial deafness, have slowly been decreasing year on year over the past three years. According to the LFS survey despite these improvements, Health and Safety Executive (HSE) statistics between 2009/10 and 2011/12 suggest that some 19,000 claims for hearing loss were reported, that were either caused, or made worse by noise at work.
